General conditions

Le présent contrat à pour objet de définir les modalités et conditions générales selon lesquelles d’une part PushMessenger, éditeur du service, met à la disposition de ses membres le service PushChat, et d’autre part, les modalités et conditions générales selon lesquelles les membres accèdent et utilisent le service proposé.

1 - Any connection to the PushChat service is subordinated to the respect of these general conditions of use.The validation of the inscription on line, implies the acceptance of the whole conditions described hereafter.The version of the general Conditions of use which prevail is the one that appears on line on the WAP and WEB (www.PushChat.com).It's the responsibility of the user to regularly consult these terms and conditions of use.The renewed use of the PushChat service by the member constitutes the acceptance of sharing of all these terms,conditions of use and warning mentions, including specially the expenses of subscription to the service.

2 - The user admits having the legal capacity to carry out contractual engagement related to the PushChat service.

3 - The purchase of a service gives access to the service immediately and involves the execution of this service. While subscribing, the member agrees to give up his right of retractation for this service.

4 - Diffusion of abusive or illict contents is stictly prohibited on PushChat and any illegal activity is not tolerated.The member must stictly conformed to the Netiquette via Wap or Web (www.pushchat.com).

5 - The member commits himself not to diffuse messages or photographs containing of the elements protected by the right of the intellectual property, the right of the private life or the right of publicity or by any other law in force unless he is not holder of rights related. By creating a photo album on PushChat or by posting a photograph in his profile, the member accepts that it stereotypes are published in various formats and that they are viewed or downloaded by the other members and this, on the PushChat service as on the other services present and future published by PushMessenger.

6 - The member is aware of the fact that PushMessenger cannot view the contents of the messages before their diffusion. Of the same PushMessenger cannot control all the contents and could not be taken as responsible for the diffusion of possible illicit contents, which could forward via its service. It is possible that certain users transmit information of defamatory nature, counterfeiting or bearing reached with the moralities and that involuntarily members are exposed to this information. In this case, the member should signal any abuses trough the headings 'complains', on the Wap or Web, or by email at webmaster@pushchat.com or even by mail PushChat BP 157 92406 Courbevoie

7 - The member is entirely responsible for the activities in which it takes part and of the remarks, messages, photographs that he diffuses on the PushChat service. PushMessenger could not be required of liability for illicity for these contributions or trepassing the royalties, of mark, patent or all other right of ownership intellectual held by a third. Moreover, the responsibility for PushMessenger could not be committed because of the information and contributions exchanged between the members.

8 - The member recognizes and accepts that PushMessenger can be brought to reveal information required in order to conform to the laws in force or so in good faith, PushMessenger thinks that such a measurement is necessary within the framework of a legal procedure, to make observe the general Conditions of use, to answer complaints asserting of the violation of the rights of third, to protect the rights or the interests of PushChat and PushMessenger, it members or the public in general.

9 - The members accept that the discussions and messages are recorded in a confidential, consultable file by the administrator only in the event of complaint towards a member to check the good faith of this one or suspicions on the respect of the conditions of use by a member. In all the cases, the administrator commits himself not communicating in any way that the contents of the messages exchanged on the safe service execpt in the event of recourse in justice.

10 - The member recognizes that the data circulating on the chat are not protected from possible diversions. The communication of any information considered to be significant or confidential is made with the risks and dangers of the member.

11 - The member recognizes that the WAP and the WEB are open and abstract networks, consisted of interconnection on an international scale of data-processing networks. The networks can have unequal line capacities and clean policies of use. No one cannot guarantee the correct operation of the WAP and the WEB as a whole.

12 - The PushChat service is accessible 24 Hours a day, 7 days on, except in the event of cause beyond control or of an event out of the control of PushMessenger, and subject to the possible breakdowns and intervention of maintenance necessary to the correct operation of the services and the tools.

13 - The member commits himself providing, at the time of his inscription with PushChat, his number of mobile in order to receive his code of activation, to be identified for the setting on line of his photographs and to receive his alarms by SMS if necessary. Any mobile number and/or email adresses provided by the member to PushMessenger remain confidential. PushMessenger is committed not to communicate them to the other members. However, the member agrees to receive four informations per month by SMS and/or email.

14 - In accordance with the Law n°78-17 of January 6, 1978 (law known as "Data-processing and Freedoms"), the members have a right of access, of correction and suppression (art 34 of the law) of the data which relate to them and which were made available of PushChat during the use of its services WAP and WEB. To exert it, they must address a mail to: PushMessenger BP 157 - 92406 Courbevoie or an email with webmaster@PushChat.com.
